US performers owed British Pounds:

The right for performers to receive equitable remuneration for the broadcast of their recorded performances came into law on 1 December 1996. The Performing Artists' Media Rights Association (PAMRA) was set up in 1995 ahead of this right specifically to administer the resulting 'royalties' to UK performers. Although the right does not yet exist in the States, PAMRA has already started to assist certain US artists in claiming their UK royalties.

The law: The legal right PAMRA administers was introduced to the UK by way of EU Directive and has been incorporated into the Copyright Designs and Patents Act 1988 as S182D. Prior to this, only record companies had a right to the income. Monies earned since the introduction of the legal right are split 50:50 between the record companies and the performers. Due to the US not signing article 12 of the Rome Convention, the USA remains a non-qualifying territory

So why are some US artists eligible? The law states that a performer qualifies to receive equitable remuneration if the track was recorded in the UK or another qualifying territory. Once a track receives airplay in the UK or another qualifying territory royalties will be due to all the performers on the track, regardless of their citizenship because the track itself qualifies.

What is PAMRA? PAMRA is a non-profit making organisation, run by performers for performers. With 15,000+ members they are the largest performers' collecting society in the UK representing all performers - featured and non-featured.

What can PAMRA do for you? Understandably there are many US performers out there who are completely unaware of this right. PAMRA is aiming to make more performers in the USA aware of this extra revenue stream. Not only may you be owed monies but we could go even further to say artists should give more thought to their country of recording - in order that they can qualify.

PAMRA has a small team of experienced staff who can advise on any question US performers may have regarding their eligibility for recorded performance royalties and advise on all the complicated issues concerning music copyright.
